SecureDeal Terms

The terms under which Rippex Card Vault operates SecureDeal, its secure middleman service for collector-to-collector card deals.

1.Definitions

For these Terms:

2.What SecureDeal Is

SecureDeal is a paid service in which RCV acts as a secure middleman between two people who have privately agreed a trading-card deal. RCV verifies the cards sent by each Party against what was declared when the Deal was booked, and does not dispatch any card to its new owner until the conditions of the Deal are met.

RCV does not buy, sell, or take ownership of the cards at any point, and does not hold, transmit or take any part in the money side of a Deal beyond collecting its own SecureDeal Fee. Any money owed between the two Parties is paid directly between them, outside of RCV, and the Party owed money confirms in their Hub that they have received it.

3.Booking and Agreement

A Deal is booked by one Party, who provides both sides' details, including the cards each side is sending and their Declared Values. Where the booking Party books while signed in to their Hub, their acceptance of these Terms at booking also records their Agreement to the Deal; the other Party must still review and Agree the Deal before anything proceeds. Where a Deal is booked without signing in, booking is not itself Agreement for either Party: both Parties, including the one who booked it, are sent a link to review and Agree the Deal, and nothing proceeds until both have.

The invite to Agree stays open for 14 days from booking. If either Party has not Agreed within that time, the Deal is automatically cancelled and both Parties are notified, and any SecureDeal Fee paid is refunded in full.

4.Sending Your Cards

Once both Parties have Agreed, each side sends their cards to RCV, at their own cost and by whatever means they choose. RCV recommends a tracked, insured service, but does not require one. Risk in a Party's own cards remains with that Party until RCV has logged them as received.

5.Verification

When cards arrive, RCV checks each one against the description and Declared Value given at booking, including photographing it; both Parties can see these photographs in their Hub.

If a card does not match what was declared, that whole side of the Deal is placed on hold; the matching cards on that side are not released separately while the mismatch is unresolved. RCV will notify both Parties and propose options, which may include returning the card, adjusting the Deal's terms, or cancelling it. RCV verifies and reports on condition; it is for the Parties to decide how to proceed.

6.Payment Between Parties

Any money owed between the Parties is paid directly between them, outside of RCV. The Party owed money confirms receipt in their Hub. RCV is not a party to, and does not process, hold or guarantee, any payment made between the two Parties.

If a Party confirms in their Hub that they have received payment, and that confirmation later turns out to be false, or the payment is later reversed or fails, after RCV has released a card on the basis of that confirmation, this is a matter between the two Parties. RCV's responsibility is limited to verifying and reporting the condition of the cards accurately and acting in good faith on the confirmation it was given.

7.SecureDeal Fees

The SecureDeal Fee is fixed, not a percentage, and is calculated from the combined Declared Value of the cards involved, as published at rippex.co.uk/securedeal at the time the Deal is booked.

For a Buy/Sell Deal, the Fee is charged once, in full, to the Party who booked the Deal, based on the value of the cards being sent; if the two Parties wish to split this cost between themselves, that is a private arrangement between them and does not change what RCV charges or to whom. For a Trade, the fee ladder is read from the combined Declared Value of both sides' cards together, and each Party pays that same Fee individually; adding money to a Trade does not change how the Fee is calculated.

The SecureDeal Fee is collected once a Party Agrees to the Deal. Sending cards to RCV remains each Party's own cost, as set out in section 4. Shipping and insurance for cards RCV sends on to a Party are priced separately from the SecureDeal Fee, at cost, once RCV has verified and weighed the actual parcel being sent, and are collected from the receiving Party before dispatch, as set out in section 11.

RCV is registered for VAT. Every price shown includes VAT at the rate in force, and this applies equally to the SecureDeal Fee and to shipping and insurance. A VAT invoice for each payment is available in the paying Party's hub at rippex.co.uk/myhub as soon as the payment completes.

8.Dispatch and Completion

Cards are only dispatched to their new owners once verification is complete for both sides, any money owed has been confirmed as received by the Party owed it, and the SecureDeal Fee has been paid by both Parties as applicable. RCV dispatches cards tracked, and the Deal is marked complete once both legs are sent.

9.Cancellation

You may cancel a Deal at any time before both Parties have Agreed it, at no cost, and any SecureDeal Fee already paid is refunded in full.

Once both Parties have Agreed and RCV has begun acting on the Deal, for example verifying cards that have arrived, you can still cancel, but RCV may deduct the reasonable cost of work already carried out (such as verification already completed, or return postage already incurred) from any refund of the SecureDeal Fee. RCV will never charge more than the costs it has actually incurred.

10.If a Deal Doesn't Complete

If one Party sends their cards and the other Party never does, the item already received is returned to the Party who sent it. Any return postage cost is deducted from the non-performing Party's paid SecureDeal Fee rather than charged to the Party who acted in good faith, whose own Fee is refunded in full.

11.Shipping and Insurance

Sending cards to RCV is the sending Party's own responsibility and cost, by whatever shipping method they choose. Cards remain at the sender's own risk in transit until RCV has logged them as received.

When RCV dispatches cards to a Party, that Party chooses the outbound shipping service and, if they wish, additional insurance, once RCV has verified and weighed the actual parcel being sent, and pays for that shipping and any insurance separately from the SecureDeal Fee, at cost, before dispatch. The Declared Value of the cards in that parcel is used both for any customs declaration required for a destination outside the UK and, where insurance is added, as the sum insured. Each shipping service carries its own built-in level of compensation, shown to the Party when they choose it; a Party who does not add insurance is covered only to that service's own limit, not to the card's full value.

Once a card has left RCV's possession, responsibility for loss, theft or damage in transit rests with the shipping service used and any insurance the receiving Party chose, not with RCV. This does not affect RCV's own responsibility for anything that happens to a card while it remains in RCV's possession, which is addressed in section 12.

12.Limitation of Liability

RCV will exercise reasonable care while cards remain in its possession. Subject to applicable law, RCV's liability for loss or damage to cards while in its custody shall not exceed the cards' proven Declared Value.

RCV shall not be liable for indirect, consequential or economic losses, or for the conduct of the other Party to a Deal, except where liability cannot lawfully be excluded.

13.Data Protection

RCV processes personal information in accordance with its Privacy Notice and applicable UK data protection legislation.

14.Electronic Signature

Ticking the acceptance statements and Agreeing to a Deal in your Hub constitutes your acceptance of these Terms for that Deal. RCV records the accepted terms version, the timestamp, and related audit information.

15.Amendments

RCV may update these Terms from time to time. The version accepted by a Party at the time they Agree to a Deal applies to that Deal.

16.Governing Law

These Terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
